    Can I Take Mental Health Leave From Work in California?

    "Mental health leave" in California is really two separate questions. Money during time off may come from State Disability Insurance (SDI), which EDD administers and which can cover mental as well as physical conditions. Job protection is separate and comes from laws such as FMLA and CFRA; that leave process is administered through your employer, while whether you are legally entitled to protection depends on the statutes and regulations and on your and your employer’s facts. A licensed clinician’s role is narrower: evaluating your symptoms and how they affect work functioning, treating you, and completing certification or documentation when it is clinically appropriate.

    How Does Mental Health Leave Work in California?

    There is no single California program called “mental health leave.” The phrase usually means time away from work because of a mental health condition, with possible wage replacement from one system and possible job protection from another.

    Keeping these separate helps you plan realistically, because each has its own rules and its own decision-maker.

    • Wage replacement: California State Disability Insurance (SDI), decided by EDD
    • Job protection: laws such as FMLA and CFRA, administered through your employer and governed by the statutes and the facts
    • Clinical side: evaluation, treatment, and certification or documentation from a licensed practitioner when clinically appropriate

    Can mental health conditions count for California SDI?

    EDD states that Disability Insurance can apply to a physical or mental illness or injury that prevents you from doing your regular or customary work. So a mental health condition is not excluded as a category.

    That does not mean a diagnosis by itself establishes disability. Eligibility turns on the facts: whether you are unable to do your regular work, for how long, your wage loss, your work history, and a practitioner’s certification based on an actual evaluation.

    What does EDD generally look for?

    EDD describes general Disability Insurance eligibility requirements that include the following. EDD reviews each claim individually and makes the final determination.

    • Being unable to do your regular or customary work for at least eight days
    • Losing wages because of the disability
    • Being employed or actively looking for work when the disability began
    • Having at least $300 in SDI-covered wages during your base period
    • Having your condition certified by a licensed physician or practitioner

    How much does California SDI pay in 2026?

    For 2026, EDD describes Disability Insurance benefits as generally about 70 to 90 percent of prior wages, with weekly amounts from $50 up to $1,765, payable for up to 52 weeks. The exact figure depends on your base-period earnings, and only EDD calculates it.

    Does SDI protect my job?

    No. EDD is explicit that Disability Insurance is wage replacement and does not provide job protection. Job protection, when it applies, comes from separate laws such as FMLA and CFRA, and it depends on things like employer size, how long you have worked there, and your hours.

    This is one of the most common misunderstandings we see. Receiving benefits and having a protected leave are two different things that can, but do not always, overlap.

    What does a clinician actually do?
